Utah school bomb plot: from inspiration to prevention, Columbine had a part

One suspect in the Utah high school bomb plot interviewed the Columbine principal in December. Police were tipped off by a friend of the suspect who received a suspicious message.?

An apparent school bombing plot foiled this week in Utah illustrates how much the Columbine massacre still resonates more than 10 years later.

One of the Utah suspects was so fascinated by the 1999 mass shootings at Colorado?s Columbine High School that he visited the school in December and interviewed the principal.

But the lessons of Columbine, including the importance of encouraging students to come forward about anything that might indicate a threat of school violence ? also appear to have borne fruit in this case.

The 16-year-old suspect?s friend and classmate, Bailey Gerhardt, reported a suspicious text message to an administrator at Roy High School: ?If I told you to stay home on a certain day, would you?? the text read, the Salt Lake Tribune reports.

The minor boy, as well as 18-year-old Roy High School student Dallin Morgan, were arrested Wednesday on suspicion of conspiracy to commit mass destruction. Police say months of planning went into their plot to set off a bomb during an assembly at the 1,500-student school and then try to escape by stealing an airplane.

No school assemblies were imminent, but had Bailey not come forward, ?it could have been a disaster,? Roy police spokeswoman Anna Bond said Thursday. The minor had previously made a pipe bomb, and both students had information about school security cameras and had been using flight simulator software, police said.

The Columbine connection in this case is the most extreme example seen by several school safety experts interviewed by the Monitor. It?s not uncommon for students to joke about Columbine or to refer to it when making real threats, they say.

But ?to go as far as to interview the principal and physically go there ? sends a message that they were extremely committed to doing something,? says Kenneth Trump, president of National School Safety and Security Services in Cleveland.

Columbine Principal Frank DeAngelis told the Associated Press that the student in question, who is not being named because he is a minor, asked to interview him for a story for his school newspaper. Mr. DeAngelis often fields such requests, he said, but in light of the arrests in Utah, he won?t do such interviews without first clearing it with security officials, the AP reports.

Wanting to emulate, or outdo, an incident like Columbine doesn?t happen in a vacuum, triggered by the Columbine massacre alone, notes William Pollack, a Harvard psychiatry professor and school-violence expert. It?s more like a ?gating phenomenon,? he says, where people might study it to do harm and feel encouraged by it to go through that gate, ?but they won?t do that if they?re not already there? ? motivated and committed for other reasons, he says.

While more information is likely to emerge about possible motives for the alleged plot, Bailey commented to investigators that the suspect had been angry after a former girlfriend broke up with him. Both teens wanted ?revenge on the world,? according to quotes in court documents as reported by the Salt Lake Tribune.

Bailey?s willingness to come forward ?says something for the school environment,? says Dr. Pollack, who was involved in post-Columbine studies on school shooters and the reasons why bystanders do or don?t report suspicious information.

More and more school administrators have taken the lessons of such reports to heart and ?see safe school climates as essential,? Pollack says. And whether it?s about bullying or a bomb plot, ?kids are more willing to come forward in general to talk about difficulties, or fears they have that someone may be hurt.?

In too many schools, safety training for staff is on the decline because of budget cuts, Mr. Trump cautions. He says calls for consulting are increasing from lawyers who are suing because of negligence and lack of safety in schools, and decreasing from from schools trying to be proactive.

But some of the most important steps aren?t very dependent on school budgets, says William Modzeleski, a school-safety consultant to the US Department of Education. It?s about being willing to put in the time to open up lines of communication between kids and adults, he says. ?Kids want to be talked with and feel they can go to someone.?

Man pleads no contest to stalking Halle Berry (Reuters)

(Reuters) ? A man with a criminal history who showed up at Oscar winner Halle Berry's house in the Hollywood Hills pleaded no contest on Thursday to a charge of stalking her, and a judge ordered him to stay 200 yards away from the actress for 10 years.

Los Angeles Superior Court Judge Dennis Landin also handed down a 386-day jail sentence to the 28-year-old man, Richard Franco.

But Franco will soon be released because he has already served half that term behind bars since his arrest in July, and he is being given credit for the other half of the sentence under measures to reduce overcrowding in the Los Angeles County jail system, prosecutors said.

Franco, who according to Los Angeles police has a history of violence, theft and drug offenses, was found to have a book with "nonsensical ramblings" and Berry's name in his handwriting, the actress said in court papers filed last year.

Franco first approached Berry's home on July 9, 2011, when she was talking to her manager and saw through a glass door that Franco -- whom she does not know -- was in the gated backyard, the papers stated. Berry's manager yelled at Franco and he left, she said in the papers.

The actress further said that on July 10, she went to her kitchen to get a Diet Coke and noticed Franco was on the other side of a glass door, less than one foot away.

She said she ran upstairs to call police. That evening, arrangements were made to have armed security officers at her home, and Franco was caught when he returned the next day.

Los Angeles police Detective John Gregozek testified in court last year that he spoke to Berry a day after the defendant's arrest.

"She was afraid for her safety and that of her daughter, as well," Gregozek said. "She hired armed security to stay at her residence 24 hours."

As a result of his plea, a residential burglary charge against Franco was dismissed.

In addition to jail time and the stay away order, Franco was placed on five years probation and ordered to undergo one year of psychological counseling, said Los Angeles deputy district attorney Wendy Seagall.

Obama pitches tourism, campaign on East coast (AP)

NEW YORK ? From the Magic Kingdom to the Apollo Theater, President Barack Obama on Thursday made the case for American tourism and his own re-election bid, mingling his political and economic agendas as he tried to stay ahead of the Republicans chasing after his job.

"I hope you know that the values you cherish, what you stand for, what you believe in, are the things I cherish and I believe in and I'm willing to fight for," Obama said at Daniel, an exclusive Manhattan restaurant, in the first of four glitzy fundraisers.

Presidential politics were not far from the surface during events on both ends of the East Coast, as Obama sought a piece of Florida's political spotlight ahead of a Jan. 31 Republican presidential primary with a high-profile appearance at Walt Disney World. Against the backdrop of Disney's Cinderella castle, Obama announced initiatives aimed at making it easier for citizens of China and Brazil to visit the United States.

"America is open for business," Obama said under Florida's picture-perfect blue skies. "We want to welcome you."

Later, the president told top donors in New York that he had made American foreign policy stronger during his first term, vowing that U.S. support for Israel's security is "nonnegotiable." He also defended his administration's approach to Iran, saying even Tehran has acknowledged that U.S. sanctions are having an impact.

The New York itinerary included a $35,800 per ticket fundraiser at the home of film director Spike Lee and an event starting at $100 per ticket at the famed Apollo Theater featuring performances by singers Al Green and India.Arie.

Outside the theater, more than 100 people demonstrated on behalf of several groups, including Occupy Wall Street and MoveOn.org, and some carried signs that read "Obama Wall Street Stooge" and "Capitalism (equals) `Democracy' for Billionaires."

Inside, Obama touted his administration's work on everything from health care to ending the Iraq war. But he warned an enthusiastic crowd of about 1,400 supporters that, "everything we did over the last three years is now at stake in this election."

At a separate fundraiser earlier in the night, Obama said the November election would be "as stark a choice as we have seen". He drew a contrast between the current crop of GOP presidential hopefuls and 2008 Republican nominee John McCain, who Obama said shared some of his views on banning torture, climate change and closing the prison at Guantanamo Bay, Cuba.

"If you've been listening to the Republican debates, they have moved," Obama said. "I've stayed here. They've gone in a different direction."

Obama's trip to Florida marked an attempt by the White House and his campaign to steal attention from Republicans vying for the GOP presidential nomination. In recent weeks Obama held a live video conference with Iowa voters during the Republican caucus, Vice President Joe Biden held a similar event with voters in New Hampshire on the night of the state's first-in-the-nation primary and next week Obama will travel to Nevada, which follows Florida on the primary calendar.

Obama was greeted in the Orlando area by ads from GOP front-runner Mitt Romney blaming the president for the state's struggling economy. Romney, the former Massachusetts governor, could take a major step toward securing the Republican nomination with a win in Florida's Jan. 31 primary contest.

"I have a simple question for you: Where are the jobs?" Romney wrote in an open letter to the president on Thursday running as an ad in the Tampa Bay Times. In a conference call with reporters, Romney said Obama was "speaking from Fantasyland."

While Obama carried Florida in 2008, the state is a top target for Republicans in the November elections. Florida twice backed Republican George W. Bush, providing the decisive electoral votes in the cliffhanger 2000 election that was decided after a 36-day recount.

Tourism is a key component to the economy in Florida, which has been battered by 10 percent unemployment and rampant home foreclosures.

The White House said more than 1 million U.S. jobs could be created over the next decade, according to industry projections, if the U.S. increases its share of the international travel market.

The tourism initiative is part of an executive order Obama signed. Its goal is to boost nonimmigrant visa processing capacity in China and Brazil by 40 percent this year; expand a Visa Waiver Program that allows participating nationals to travel to the U.S. for stays of 90 days or less without a visa; appoint a new group of chief executives to the U.S. Travel and Tourism Advisory Board; and direct an interagency task force to develop recommendations for a National Travel and Tourism Strategy, including promoting national parks and other sites.

The efforts to boost tourism were praised by travel and tourism groups, but one lawmaker said the decision to relax tourist visas could undermine national security. Sen. Chuck Grassley, R-Iowa, said the administration was "pushing the envelope and using their authority beyond congressional intent," noting that only two of the 19 hijackers in the 9/11 terrorist attacks were interviewed by consular offices. He said Congress moved to require visa applicants to be interviewed as a result.

The White House says the travel and tourism industry represented 2.7 percent of gross domestic product and 7.5 million jobs in 2010. But the U.S. share of spending by international travelers fell from 17 percent to 11 percent between 2000 and 2010, due to increased competition and changes in global development, as well as security measures imposed after Sept. 11, 2001, according to the White House.

The approach was welcomed by Brazilian tourists Lilian Lara and Lindbergh Souza, who shopped along the resort's streets hours before the president's speech. Souza said the visa process was expensive, at $500, and time-consuming for Brazilians who don't live close to consuls in Rio de Janiero and Sao Paulo. "The whole process took me six months," Souza said.

Washington St. women lose to No. 4 Stanford 75-41 (AP)

STANFORD, Calif. ? For nearly 18 minutes, Washington State coach June Daugherty saw just about everything she wanted to from her team.

The Cougars took everything No. 4 Stanford threw at them and even built an early lead against the Cardinal before it all fell apart in the second half. That's when Stanford coach Tara VanDerveer switched defenses and Washington State failed to adjust, losing 75-41 on Thursday night.

"I thought we really were on point as far as running our game plan (early)," Daugherty said. "We mixed up the defenses quite a bit and then offensively ... when we didn't have good shots, we spaced the floor, moved to cut a lot better and tried to force Stanford to play into the shot clock a little bit."

It's the second time in their last five games that the Cougars (9-9, 3-3 Pac-12) have gotten off to a quick start, only to see it go to waste in the second half.

Washington State didn't have a player in double figures, shot just 27.7 percent for the game and remained winless in 53 meetings against Stanford.

"I just thought they came out and were really aggressive," VanDerveer said of the Cougars. "I don't think the score indicates how well they played. I just think they got a little discouraged and we turned it up in the second half."

Shalie Dheenshaw had seven points to lead Washington State, which has lost three straight under Daugherty, a former Stanford assistant June Daugherty, since opening the Pac-12 schedule with three consecutive wins.

Nnemkadi Ogwumike had 22 points and 10 rebounds, Chiney Ogwumike added 19 points and 12 rebounds while Joslyn Tinkle had nine points, eight rebounds and four assists as the Cardinal extended their school-record home winning streak to 72 games.

Stanford (16-1, 7-0 Pac-12) looked ragged in the early going before Nneka Ogwumike provided a spark, scoring 12 points in the first nine minutes of the second half. She then sat out the rest of the game, finishing 9 for 19 from the floor and moving into sixth place on the Cardinal's career scoring list.

The Pac-12's top-shooting team going in, Stanford was out of sorts offensively for the first 14 minutes of the game. The Cardinal missed 18 of their first 24 shots, committed careless turnovers and trailed 16-13 before Ogwumike's steal and layup triggered a 16-2 run capped by Bonnie Samuelson's 3-pointer.

Ogwumike moved past Jeanne Ruark Hoff on Stanford's charts and now has 2,055 career points. She needs eight more to slip past Nicole Powell into fifth place and only 23 to move past Val Whiting.

The Cardinal got off to a slow start against the Cougars 3-2 zone before Nneka and younger sister Chiney got them going, both scoring and working the boards. The duo combined to match Washington State's scoring total and was especially tough inside.

Chiney, the conference player of the week, had eight points coming out of halftime and got an assist on a short pass in the key to Nneka during a 24-6 blitz by Stanford that put the game out of reach.

That helped overcome a rough night from Stanford's perimeter shooting. The Cardinal were only 4 of 20 on 3s.

Stanford also got a boost from its own defense, which held the Cougars to 27.3 percent shooting. VanDerveer, who has juggled her lineup in recent weeks, had the Cardinal move to a high 2-3 zone which gave Washington State fits.

"That's when we struggled the most," Daugherty said. "We missed some very easy layups and they stayed in it. Of course you'd stay in it when teams are missing easy layups."

As rough a start as Stanford had shooting in the first half, it was the defense that kept it from being much of an issue.

The Cardinal forced 11 turnovers and had six steals before halftime, two from Tinkle who broke up a pass in the key and fed Toni Kokenis with a long pass and easy layup just before the buzzer to give Stanford a 31-20 lead.

Washington State, which shot 30 percent in the first half, never recovered and extended its winless streak against Stanford.

Plextor's new external DVD burner works with TVs, no computer required

Plextor's been plenty busy this week, announcing its new M3 Pro SSD and PlexEasy external DVD burner, but the company's not done unveiling new products just yet. Plextor's newest offering is another external DVD burner, the easily remembered PX-612U. Like the PlexEasy, it connects via USB and works with TVs and media streamers without needing a PC. That's possible thanks to some secret sauce called PlexTV (not to be confused with the media client), which acts as a code translator to make the PX-612U's output mimic a HDD. It'll be available the first quarter of this year, for an as-yet-unknown number of dollars.

Rich seek super-sized luxury London pads (Reuters)

LONDON (Reuters) ? London developers are shifting their focus toward super-sized luxury flats to keep pace with the growing wealth of overseas buyers seeking a safe haven for their cash, charging them up to 70 percent more for the privilege.

"As the level of wealth among the very rich increases, they are rewriting the 'pied-a-terre' rules. Although their London buy might be a second or third home, they now expect it to have the same size, specification and services as their domicile property," said Rupert Dawes, a partner at international property consultant Knight Frank.

Berkeley Group is building flats of up to 4,000 square feet, about the size of one and a half tennis courts, that can be knocked together for buyers wanting an extra-large home. The development, called Ebury Square in the upmarket district of Belgravia is due to come on sale this summer.

"The top end of the London real estate sector is seeing a new appetite for super-sized floorplates in new apartments," said Paul Vallone, managing director of Berkeley Urban Renaissance.

"International purchasers accustomed to large riads or dachas are now expecting their London property to be as spacious as possible."

The London property market's appeal as a liquid and transparent investment in a relatively stable political and fiscal environment has attracted a wave of overseas buyers during the global financial crisis.

The typical size of a large flat in a luxury development grew from 3,000 square feet in 2000 to 5,000 square feet in 2007 and increasing numbers of wealthy buyers are now hunting for 6,000 square feet properties Knight Frank said.

Nick Candy, chief executive of Candy and Candy, the development manager for London's luxury One Hyde Park scheme that completed a year ago, where the most expensive flat sold for 136 million pounds ($209 million), said his company was the first to plug the gap in the London market.

"The largest flat in One Hyde Park is circa 30,000 square feet which is like a stately home in the sky," he said.

That could be topped by plans for the former site of the In and Out naval and military club on Piccadilly that may include an estimated 50,000 square-foot residence, about the size of 100 average one-bed flats, with a possible price tag of 250 million pounds. Architect Paul Davis + Partners began working on the scheme last year.

20 Grosvenor Square in Mayfair is the former site of the U.S. Naval Club being developed by a consortium headed by Richard Caring, the clothing tycoon who owns upmarket London restaurants including The Ivy and Scott's.

In November, plans were approved to cut the number of flats from 41 to 31 and boost the total floor space by 7 percent to about 150,000 square feet to meet demand for huge floor areas, said Jane Wagner, director of Waltonwagner, the scheme's development manager.

"Tastes have got less 'blingy' over the years and buyers increasingly look for large flexible spaces," she said. "Many Russians and Arabs want large reception rooms to hold business functions or cocktail parties or for conversion into gyms."

Buyers will pay a premium of up to 70 percent for super-sized apartments depending on the scheme, said Ziad Salem, founder of luxury property specialist Byblos Property, citing the case of the 199 Knightsbridge development in London.

"It has a handful of flats between 5,000 and 7,000 square feet but you will pay 5,000 to 6,000 pounds per foot compared to between 3,500 and 4,000 pounds for the smaller units because you get more space." It was typical of premiums elsewhere, he said.

Developers are finding it difficult to meet demand because many properties in London's most sought-after areas have historical value and are protected against demolition or alteration, Salem said.

"Developers are only starting to catch up with demand because finding sites is so difficult. I get phone calls every day from Russian and Arab clients looking for large flats with high ceilings. I have to tell them to be patient."

Other buyers are trying to beat developers at their own game by acquiring blocks in need of conversion directly, said Wagner. ($1 = 0.6513 British pounds)

The White House announced today from Hawaii that President Obama had signed into law a major defense policy bill, but Mr. Obama at the same time served notice to Congress that he would ignore certain provisions dealing with detainees in the War on Terror.

? Statement by the President on H.R. 1540

? Today I have signed into law H.R. 1540, the "National Defense Authorization Act for Fiscal Year 2012." I have signed the Act chiefly because it authorizes funding for the defense of the United States and its interests abroad, crucial services for service members and their families, and vital national security programs that must be renewed. In hundreds of separate sections totaling over 500 pages, the Act also contains critical Administration initiatives to control the spiraling health care costs of the Department of Defense (DoD), to develop counterterrorism initiatives abroad, to build the security capacity of key partners, to modernize the force, and to boost the efficiency and effectiveness of military operations worldwide.

? The fact that I support this bill as a whole does not mean I agree with everything in it. In particular, I have signed this bill despite having serious reservations with certain provisions that regulate the detention, interrogation, and prosecution of suspected terrorists. Over the last several years, my Administration has developed an effective, sustainable framework for the detention, interrogation and trial of suspected terrorists that allows us to maximize both our ability to collect intelligence and to incapacitate dangerous individuals in rapidly developing situations, and the results we have achieved are undeniable. Our success against al-Qa'ida and its affiliates and adherents has derived in significant measure from providing our counterterrorism professionals with the clarity and flexibility they need to adapt to changing circumstances and to utilize whichever authorities best protect the American people, and our accomplishments have respected the values that make our country an example for the world.

? Against that record of success, some in Congress continue to insist upon restricting the options available to our counterterrorism professionals and interfering with the very operations that have kept us safe. My Administration has consistently opposed such measures. Ultimately, I decided to sign this bill not only because of the critically important services it provides for our forces and their families and the national security programs it authorizes, but also because the Congress revised provisions that otherwise would have jeopardized the safety, security, and liberty of the American people. Moving forward, my Administration will interpret and implement the provisions described below in a manner that best preserves the flexibility on which our safety depends and upholds the values on which this country was founded.

? Section 1021 affirms the executive branch's authority to detain persons covered by the 2001 Authorization for Use of Military Force (AUMF) (Public Law 107-40; 50 U.S.C. 1541 note). This section breaks no new ground and is unnecessary. The authority it describes was included in the 2001 AUMF, as recognized by the Supreme Court and confirmed through lower court decisions since then. Two critical limitations in section 1021 confirm that it solely codifies established authorities. First, under section 1021(d), the bill does not "limit or expand the authority of the President or the scope of the Authorization for Use of Military Force." Second, under section 1021(e), the bill may not be construed to affect any "existing law or authorities relating to the detention of United States citizens, lawful resident aliens of the United States, or any other persons who are captured or arrested in the United States." My Administration strongly supported the inclusion of these limitations in order to make clear beyond doubt that the legislation does nothing more than confirm authorities that the Federal courts have recognized as lawful under the 2001 AUMF. Moreover, I want to clarify that my Administration will not authorize the indefinite military detention without trial of American citizens. Indeed, I believe that doing so would break with our most important traditions and values as a Nation. My Administration will interpret section 1021 in a manner that ensures that any detention it authorizes complies with the Constitution, the laws of war, and all other applicable law. ?

Section 1022 seeks to require military custody for a narrow category of non-citizen detainees who are "captured in the course of hostilities authorized by the Authorization for Use of Military Force." This section is ill-conceived and will do nothing to improve the security of the United States. The executive branch already has the authority to detain in military custody those members of al-Qa'ida who are captured in the course of hostilities authorized by the AUMF, and as Commander in Chief I have directed the military to do so where appropriate. I reject any approach that would mandate military custody where law enforcement provides the best method of incapacitating a terrorist threat. While section 1022 is unnecessary and has the potential to create uncertainty, I have signed the bill because I believe that this section can be interpreted and applied in a manner that avoids undue harm to our current operations.

? I have concluded that section 1022 provides the minimally acceptable amount of flexibility to protect national security. Specifically, I have signed this bill on the understanding that section 1022 provides the executive branch with broad authority to determine how best to implement it, and with the full and unencumbered ability to waive any military custody requirement, including the option of waiving appropriate categories of cases when doing so is in the national security interests of the United States. As my Administration has made clear, the only responsible way to combat the threat al-Qa'ida poses is to remain relentlessly practical, guided by the factual and legal complexities of each case and the relative strengths and weaknesses of each system. Otherwise, investigations could be compromised, our authorities to hold dangerous individuals could be jeopardized, and intelligence could be lost. I will not tolerate that result, and under no circumstances will my Administration accept or adhere to a rigid across-the-board requirement for military detention. I will therefore interpret and implement section 1022 in the manner that best preserves the same flexible approach that has served us so well for the past 3 years and that protects the ability of law enforcement professionals to obtain the evidence and cooperation they need to protect the Nation.

? My Administration will design the implementation procedures authorized by section 1022(c) to provide the maximum measure of flexibility and clarity to our counterterrorism professionals permissible under law. And I will exercise all of my constitutional authorities as Chief Executive and Commander in Chief if those procedures fall short, including but not limited to seeking the revision or repeal of provisions should they prove to be unworkable.

? Sections 1023-1025 needlessly interfere with the executive branch's processes for reviewing the status of detainees. Going forward, consistent with congressional intent as detailed in the Conference Report, my Administration will interpret section 1024 as granting the Secretary of Defense broad discretion to determine what detainee status determinations in Afghanistan are subject to the requirements of this section.

? Sections 1026-1028 continue unwise funding restrictions that curtail options available to the executive branch. Section 1027 renews the bar against using appropriated funds for fiscal year 2012 to transfer Guantanamo detainees into the United States for any purpose. I continue to oppose this provision, which intrudes upon critical executive branch authority to determine when and where to prosecute Guantanamo detainees, based on the facts and the circumstances of each case and our national security interests. For decades, Republican and Democratic administrations have successfully prosecuted hundreds of terrorists in Federal court. Those prosecutions are a legitimate, effective, and powerful tool in our efforts to protect the Nation. Removing that tool from the executive branch does not serve our national security. Moreover, this intrusion would, under certain circumstances, violate constitutional separation of powers principles.

? Section 1028 modifies but fundamentally maintains unwarranted restrictions on the executive branch's authority to transfer detainees to a foreign country. This hinders the executive's ability to carry out its military, national security, and foreign relations activities and like section 1027, would, under certain circumstances, violate constitutional separation of powers principles. The executive branch must have the flexibility to act swiftly in conducting negotiations with foreign countries regarding the circumstances of detainee transfers. In the event that the statutory restrictions in sections 1027 and 1028 operate in a manner that violates constitutional separation of powers principles, my Administration will interpret them to avoid the constitutional conflict.

? Section 1029 requires that the Attorney General consult with the Director of National Intelligence and Secretary of Defense prior to filing criminal charges against or seeking an indictment of certain individuals. I sign this based on the understanding that apart from detainees held by the military outside of the United States under the 2001 Authorization for Use of Military Force, the provision applies only to those individuals who have been determined to be covered persons under section 1022 before the Justice Department files charges or seeks an indictment. Notwithstanding that limitation, this provision represents an intrusion into the functions and prerogatives of the Department of Justice and offends the longstanding legal tradition that decisions regarding criminal prosecutions should be vested with the Attorney General free from outside interference. Moreover, section 1029 could impede flexibility and hinder exigent operational judgments in a manner that damages our security. My Administration will interpret and implement section 1029 in a manner that preserves the operational flexibility of our counterterrorism and law enforcement professionals, limits delays in the investigative process, ensures that critical executive branch functions are not inhibited, and preserves the integrity and independence of the Department of Justice.

? Other provisions in this bill above could interfere with my constitutional foreign affairs powers. Section 1244 requires the President to submit a report to the Congress 60 days prior to sharing any U.S. classified ballistic missile defense information with Russia. Section 1244 further specifies that this report include a detailed description of the classified information to be provided. While my Administration intends to keep the Congress fully informed of the status of U.S. efforts to cooperate with the Russian Federation on ballistic missile defense, my Administration will also interpret and implement section 1244 in a manner that does not interfere with the President's constitutional authority to conduct foreign affairs and avoids the undue disclosure of sensitive diplomatic communications. Other sections pose similar problems. Sections 1231, 1240, 1241, and 1242 could be read to require the disclosure of sensitive diplomatic communications and national security secrets; and sections 1235, 1242, and 1245 would interfere with my constitutional authority to conduct foreign relations by directing the Executive to take certain positions in negotiations or discussions with foreign governments. Like section 1244, should any application of these provisions conflict with my constitutional authorities, I will treat the provisions as non-binding.

? My Administration has worked tirelessly to reform or remove the provisions described above in order to facilitate the enactment of this vital legislation, but certain provisions remain concerning. My Administration will aggressively seek to mitigate those concerns through the design of implementation procedures and other authorities available to me as Chief Executive and Commander in Chief, will oppose any attempt to extend or expand them in the future, and will seek the repeal of any provisions that undermine the policies and values that have guided my Administration throughout my time in office.

Big economies? maturing debt tab grows

Governments of the world?s leading economies have more than US$7.6 trillion of debt maturing this year, with most facing a rise in borrowing costs.

Led by Japan?s US$3 trillion and the US? US$2.8 trillion, the amount coming due for the G7 nations and Brazil, Russia, India and China is up from US$7.4 trillion at this time last year, according to data compiled by Bloomberg. Ten-year bond yields will be higher by the end of the year for at least seven of the countries, forecasts show.

?The weight of supply may be a concern,? Stuart Thomson, a money manager in Glasgow at Ignis Asset Management Ltd, which oversees US$121 billion, said in a Dec. 28 telephone interview. ?Rather than the start of the year being the problem, it?s the middle part of the year that becomes the problem. That?s when we see the slowdown in the global economy having its biggest impact.?

The amount needing to be refinanced rises to more than US$8 trillion when interest payments are included. Coming after a year in which Standard & Poor?s cut the US? rating to ?AA+? from ?AAA? and put 15 European nations on notice for possible downgrades, the competition to find buyers is heating up.

?It is a big number and obviously because many governments are still in a deficit situation the debt continues to accumulate and that?s one of the biggest problems,? Elwin de Groot, an economist at Rabobank Nederland in Utrecht, Netherlands, part of the world?s biggest agricultural lender, said in an interview on Dec. 27.

Italy auctioned 7 billion euros (US$9.1 billion) of debt on Dec. 29, less than the 8.5 billion euros targeted. With an economy sinking into its fourth recession since 2001, Italian Prime Minister Mario Monti?s government must refinance about US$428 billion of securities coming due this year, the third-most, with another US$70 billion in interest payments, data compiled by Bloomberg showed.

After Italy, France has the most amount of debt coming due, at US$367 billion, followed by Germany at US$285 billion. Canada has US$221 billion, while Brazil has US$169 billion, the UK has US$165 billion, China has US$121 billion and India US$57 billion. Russia has the least maturing, or US$13 billion.

The two biggest debtors, Japan and the US, have shown little trouble attracting demand.

Japan benefits by having a surplus in its current account, which is the broadest measure of trade and means that the nation doesn?t need to rely on foreign investors to finance its budget deficits. The US benefits from the US dollar?s role as the world?s primary reserve currency.

Central banks are bolstering demand by either keeping interest rates at record lows or reducing them and by purchasing bonds through a policy know as quantitative easing.

The US Federal Reserve has said it would keep its target rate for overnight loans between banks between zero and 0.25 percent through the middle of next year and is now selling US$400 billion of its short-term Treasuries and reinvesting the proceeds into longer-term government debt in a program traders dubbed Operation Twist.

The Bank of Japan has kept its key rate at or below 0.5 percent since 1995 and expanded the asset-purchase program last year to ?20 trillion (US$260 billion). The Bank of England kept its main rate at a record low 0.5 percent last month and left its asset-buying target at ?275 billion (US$426 billion).

Verzo Kinzo unboxing and impressions

Yes, the Verzo Kinzo is real! That Americano-Czech Android smartphone with mid-range specs that went on sale in November with a ludicrous $459 price tag only to be hastily relaunched earlier this month for a slightly more digestible $359 is not a giant farce. (Well, maybe it is.) It left the ethereal world of rendered computer graphics and landed in our mitts just in time for the holidays. To be specific, we received the pricier $384 Verzo Kinzo Plus GPS package, which includes a voucher for Sygic's off-line navigation app and a gaudy, Star Trek-inspired car holder. After spending a few days with the handset we are able to report that it isn't particularly impressive in this day and age but isn't completely horrible either -- not to mention the faux-Vertu packaging and branding which are rather, well... unique. So why not grab some leftover eggnog, and join us after the break for our unboxing and impressions?
